Terms of Service

1. Acceptance of Terms

By accessing or using the Utasoko website, mobile application, or any other services provided by Utasoko (collectively, the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the platform.

2. Eligibility

To use our services, you must be at least 18 years of age and capable of entering into legally binding contracts under Kenyan law. By creating an account, you represent and warrant that you meet these requirements.

3. Account Registration

You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Rental Transactions

Utasoko acts as a facilitator only. The actual contract for rent is between the Landlord/Agent and the Tenant. Utasoko is not a party to any rental agreement and disclaims all liability arising from or related to such agreements. Landlords are responsible for ensuring listings are accurate and legally compliant. Tenants are responsible for verifying the condition of the property.

5. Payments & Fees

Utasoko may charge service fees for certain transactions. All payments made through the platform are processed via our third-party payment providers (including M-Pesa). You agree to pay all applicable fees as described at the time of the transaction. Payments for deposits are held in accordance with our escrow policy.

6. Prohibited Conduct

Users are prohibited from:

• Posting false, inaccurate, or misleading content.
• Circumventing the platform to avoid service fees.
• Harassing other users or platform employees.
• Using automated systems (bots/scrapers) to harvest data.
• Attempting to defraud users or the platform.

7. Limitation of Liability

To the maximum extent permitted by law, Utasoko shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of the platform. We provide the service on an "as is" and "as available" basis without any warranties of any kind.

8. Termination

We reserve the right to suspend or terminate your account at our sole discretion, without notice, if we believe you have violated these Terms or engaged in conduct that harms the platform or its users.

9. Governing Law

These terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Nairobi, Kenya.
